Earthen Pond (non-liner) Seasonal Maintenance Agreement (OH/PA/WV)

  • All service agreements begin May 1 and end October 31.
  • PondScape will apply the proper amount of water treatments based on your selected service level.
  • Manual removal of HEAVY string algae and the cutting back of overgrown vegetation is not included with any service plan but may be contracted at an additional cost with customer's authorization. 

SERVICE LEVELS BASED ON SURFACE ACRES (SA) CALCULATED BY SATELLITE MAPPING SOFTWARE FOR "LOCAL" CUSTOMERS

  • Bronze (Basic Algae Control)
    • Includes basic Algae Control, water colorant, biologicals, visits every 14-18 days from May 1 - Oct. 31. No weeds treated. Non-resistant algae control only. (Blue green algae, horsehair algae & oscillatoria are resistant algae- move up to Silver).
  • Silver (Algae & Weed Control)
    • Includes algae and weed treatments, water colorant, biologicals, visits every 14-18 days from May 1 - Oct. 31.  Resistant/Non-Resistant Algae Control, underwater weed control, shoreline weed control.
  • Gold (Complete Pond Care program)
    • Covers all algae, all weeds, aggressive colorant use, aggressive biological use and winter service. Includes algae and weed treatments, water colorant, biologicals, visits every 14-18 days from May 1 - Oct. 31.  Resistant/Non-Resistant Algae Control, underwater weed control, shoreline weed control. Also includes weekly algae treatments June 1 - Aug. 31 as needed. Also includes monthly colorants and cold water biologicals Nov. - March if not frozen over. 
  • Additional Services
    • Sludge Assault; an aggressive muck reducer for beach, dock & shoreline areas; typical results up to 6" reduction annually
    • Fountain Service; removal of floating fountain, inspection, cleaning and storage inside and insured. Re-installed in March / April.

Customer is charged 50% of Seasonal Maintenance Plan chosen above on April 1 and the remaining balance on June 1st. Customer may pay the full invoice amount before April 1 and receive 10% off of the total.

  • All prices and charges shown on this form are to be paid in advance. There are no refunds of any sort for any reason once this form is submitted.
  • This agreement does not have any type of cancellation fee. The agreement can be cancelled by either party in writing with 30 days notice but annual prepayments are non-refundable. Should the customer decide to cancel the agreement, PondScape may reject starting a new agreement for maintenance but may still offer standard service calls based on the regular rate per call.
  • No other company shall be permitted to do any work on the pond whatsoever. Customer also shall refrain from doing any work on the pond but if so chooses, shall inform PondScape of such actions to ensure it does not interfere with any dosage or applications.
  • Fountain removal service is only available for fountains with quick-connect power wires and anchor systems. 
  • An "out of area" fee may be added for locations deemed as long distance by PondScape. The customer shall be notified of this fee prior to any charges.
  • Heavy equipment may be needed to removed very large or heavy fountain systems. Understand that this equipment may cause minor turf damage.
  • Fountains are reinstalled in the Springtime with separate charges as shown above. The customer may choose to personally pick up their fountain from PondScape anytime during the winter months or for self-installation in the Springtime. Fountains left after April 30 will be dropped off at customer's property, not installed and charged PondScape's regular hourly labor rate.
  • Our crews will not call before service. PondScape crews will only arrive between the hours of 8am-4pm Monday - Saturday.
  • You do not need to be home for the service. Please have the area accessible with water and electric provided and no dogs around.
  • PAYMENT: Customer is charged in advance for any service listed on this form. There are no refunds for recurring service work, even if contract is cancelled for any reason.
  • PondScape will not be held responsible for damages caused to neighboring properties due to the negligence of the customer to inform PondScape of proper boundaries and property lines.
  • PondScape will not be responsible for any injury whatsoever or death caused by or in any water features. Any insurance or legalities are sole responsibilities of the property owner. Electrical injuries, traumatic injuries, and all other types of injuries will be settled by the property owner only and will not affect PondScape or any of its affiliates. PondScape will only be responsible for injuries to its employees as covered by PondScape’s commercial insurance and Workman’s Compensation.
  • IMPORTANT Although our crews are extremely cautious while handling your fish and livestock, PondScape, its employees and any affiliates will not be held responsible for the death of any fish or wildlife, disease, parasites or infestations within your pond or fish as well as any damage to the surrounding landscape. We will take every precaution possible to insure the safety of the wildlife in you water feature.
  • The customer takes full responsibility for any legalities or codes of law that must be followed with his water feature. It is not the duty of PondScape to research these codes. The customer agrees to pay all legal fees and fines including, but not limited to attorney fees and court costs in the event of a lawsuit by the customer or any other person regarding this agreement for any reason what-so-ever. The customer waives his/her right to sue for these fees by signing this form even in the event of a ruling in the customer’s favor.
  • Signing this form signifies that signer is the property owner or is authorized to make decisions for the property owner. The signer of this form gives his/her personal guarantee to pay all charges incurred with this agreement and authorizes PondScape LLC to charge the credit card listed as described above.
